The Economic Surveillance Department (SEAE) of the Finance Ministry expects to complete during the current quarter its report on NeoTV?s complaint about the exclusivity of sports channel SporTV. NeoTV is a content purchasing association of cable and MMDS operators. It wants SporTV to be available to all operators rather than just franchisees of Net Brasil. The complaint was filed with the Justice Ministry, which is conducting an inquiry.
When the SEAE submits its opinion, the Justice Ministry will remit the case to CADE, the national competition tribunal, for a decision on NeoTV?s complaint.
It?s worth recalling that when asked for an opinion on Globosat?s acquisition of a stake in ESPN Brazil in 2000, the SEAE recommended approval of the deal on condition it didn?t lead to exclusivity either of the channel or of sporting events controlled by Globosat and ESPN. CADE hasn?t yet issued a ruling on the case, which also requires input from the Justice Ministry?s Economic Defense Department (SDE).
